SLK230 R170 shift lock problem

I realized my 1999 SLK230 might have a slight transmission problem. Maybe somebody can help? I can move the transmission shifter out of P without a key in the ignition or stepping on the brake. With the key in, I don't need to step on the brake to shift out of "P". I have the older type 5-speed auto tranny with 4/3/2/1 Everything else works fine. I can only remove the key when I release the brake pedal as advertised. My brake lights, reverse lights and all other transmission functions... SLK230 R170 shift lock problem
