Gear can be engaged without brake warning

Hello all, I am having a current issue with my 2008 X5 3.0l E70 80k miles. on the i drive the "Gear can be engaged without brake" warning appears. and most of the time I have to hit the brake twice for the car to start. So far I have replaced the battery (not registered) and also changed the brake light switch which was aftermarket "NewYall". I also found my trunk lid module to be corroded which I currently have unplugged.

Any help to as why I am getting the "Gear can be engaged without brake warning" and having to press on the brake twice to start would be gratefully appreciated, thank you.
